TERMS OF SALE

Premise 

What is offered in this sale, in compliance with art. 64 of the cultural heritage code (legislative decree 22.01.2004, n. 42), is guaranteed authentic and, unless otherwise indicated, free from hidden defects. The lots are offered for sale by GMA Numismatica s.r.l., which acts as an exclusive agent in its own name and on behalf of each seller whose name is transcribed in the appropriate P.S. held at the company's headquarters, except in cases where GMA Numismatica s.r.l. owns the lot. The effects of the sale affect and fall directly and exclusively on the seller, GMA Numismatica s.r.l., therefore, does not assume any responsibility towards the successful bidder or third parties in general other than that deriving from its role as agent. In particular, it should be noted that this sale constitutes a random contract and therefore the guarantee for eviction, for the purposes and for the purposes of art. 1488 paragraph 2 of the Civil Code.

All participants in the E-Live 6 auction, with closing date and time Friday 05 april 2024, starting at 02:30 pm, are required to comply with these conditions of sale. 

1. IVA SYSTEM (MARGIN SYSTEM)

All sales made by GMA Numismatica s.r.l. are operated by virtue of contracts entered into with private consumers or with IVA subjects operating under the margin regime, governed by art. 40 bis of d. l. 41/95 and subsequent amendments. By virtue of this legislation, neither IVA on services and/or services rendered to the buyer and seller.

2. AUCTION BASE

The starting price corresponds to the starting price. Offers below this price will not be considered. Estimates relating to the possible sale price of each lot, expressed in Euro, are indicated under the description of the lots shown in the catalog (print and web) and do not include the auction fees due by the successful bidder.

3. BUYERS COMMISSIONS 

The total amount to be paid by the successful bidder, for each lot, is made up of:

• Hammer price.

• 18% commission (including IVA).

4. PARTICIPATION IN THE AUCTION 

The successful bidders (Italian citizens or residents of Italy) are required to provide GMA Numismatica s.r.l. your fiscal code and the details of a valid identity document, as per the law expressed in Legislative Decree lgs. 231/2007 and by the T.U.L.P.S. approved with R.D. 773/1931.

Participation in the auction is possible through:

• sending written offers, to be sent no later than 01:30 pm on Friday 05 april 2024, by registered letter, e-mail (astagmanumismatica@gmail.com) or by telephone (081-5528245), but in the latter case a written confirmation is still required.

• the biddr.com portal by registering and with the deadline for submitting pre-auction offers by Friday 05 april 2024 at 02:30 pm.

• GMA Numismatica E-Live 6 Auction will take place on Friday 05 april 2024 starting at 02:30 pm on gma.bidinside.com by registering

50 – 200 -> 10

200 – 500 -> 20

500 – 1000 -> 50

1000 – 2000 -> 100

2000 – 5000 -> 200

5000 – 10000 -> 500

10000 – ....  -> 1000

ATTENTION: in order to guarantee the smooth running of the auction, offers coming from other portals (biddr, numisbid...) or email that do not respect the bidding schedule described above will be approximated by excess or defect at our discretion. 

GMA Numismatica s.r.l. will not apply any additional expense for the handling of the commissions with respect to the auction commission indicated in point 3. By sending the offers and signing the appropriate form, the unconditional acceptance of all the conditions of sale provided for in this regulation. Commissions that carry offers that are not well defined (eg "at best" or "to take") will not be taken into consideration without the participant being able to oppose anything in this regard. The objects are definitively awarded to the highest bidder. Transfers to third parties of lots already awarded will not be accepted and the successful bidder will be held solely, directly and personally responsible for the payment. GMA Numismatica s.r.l. reserves the right to withdraw any lot from the auction and to combine or separate the lots and possibly change the sale order during the auction itself. All at its discretion and at its sole discretion without the participant being able to oppose anything in this regard. In the case of two identical bids relating to the same lot, the same will be awarded to the bidder whose bid was received first.

The successful bidders are required to comply with all laws and / or regulations and / or regulations in force relating to objects of historical or artistic interest. Any sales to non-resident bidders in Italy will be made taking into account compliance with the relevant legislative provisions. To this end GMA Numismatica s.r.l. informs that the sale of assets of cultural interest intended for a foreign state requires the release of the certificate of free circulation by the export office of the Ministry for Cultural Heritage and Activities. The waiting period for the conclusion of the procedure is approximately 60 days from the date of submission of the request to the aforementioned office. GMA Numismatica s.r.l. cannot assume any responsibility for delays resulting from the disposal of export practices forwarded to the competent office, which reserves the right to process them based on the internal quantity of the same. Requests for exports are forwarded to the Ministry upon payment of the lot and with the explicit authorization of the successful bidder. GMA Numismatica s.r.l. assumes no responsibility towards the successful bidders with regard to any restrictions on the export of the awarded lots, nor with regard to any licenses or certificates that the successful bidder must obtain at his own expense and under the laws in force in the State. The successful bidder, in case of exercise of the right of pre-emption by the Italian State, cannot claim from GMA Numismatica s.r.l. or by the seller, no refund of any interest on the price and auction fees already paid.

5. PAYMENTS AND SHIPMENT 

The total payment of the hammer price and auction rights can be immediately demanded by GMA Numismatica s.r.l., it being understood that the ownership of the purchased lots will be transferred to the successful bidder only after the payment of the total amount has been made. In any case, it must be made in full, in Euro, within 7 days of the award. Failing that, GMA Numismatica srl, without prejudice to compensation for greater damages, may at its discretion, and alternatively, proceed to enforce the compulsory purchase obligation, or sell the lot under private negotiation or in an auction. to the detriment of the successful bidder, withholding any advances received as a penalty. The object will be kept at the risk and expense of the successful bidder until it is sold as above or returned to the seller at the request of the same.

6. CONDITIONS

We do not accept complaints and returns of the goods after seven days from the date of receipt of the same, in this regard it should also be noted that no complaints will be allowed for any defects mentioned in the descriptions of the lots or in any case easily found in photographs. The dispatch of the disputed material must be made by insured, non-cash on delivery (under penalty of refusal of the same) and using suitable packaging. The sender is directly responsible for the care of the material until it is delivered to GMA Numismatica s.r.l. The disputed items must be returned in the same original conditions.

These conditions of sale are automatically accepted by those taking part in the auction and are available to any interested party who requests them. For any dispute, the exclusive jurisdiction of the Naples Court is established.
